The Key Legislation
The Food Safety Act 1990
This is the cornerstone of UK food safety law. It makes it an offence to:
- Sell food that is injurious to health
- Sell food that is not of the nature, substance, or quality demanded by the consumer
- Falsely describe or present food
Businesses found in breach of the Food Safety Act can face unlimited fines and up to two years in prison.
The Food Hygiene (England) Regulations 2006
These regulations implement EU Regulation 852/2004 (retained in UK law post-Brexit) and require food businesses to:
- Register with their local authority
- Implement a food safety management system based on HACCP (Hazard Analysis and Critical Control Points) principles
- Ensure food handlers receive appropriate training in food hygiene
- Maintain adequate records of food safety procedures
The Food Standards Act 1999
This Act established the Food Standards Agency (FSA), the independent government body responsible for food safety and hygiene across the UK. The FSA sets national standards and works with local authorities to enforce food safety law.
The Food Hygiene Rating Scheme
The Food Hygiene Rating Scheme (FHRS) is operated by local authorities in England, Wales, and Northern Ireland. Businesses are inspected and rated on a scale of 0 to 5:
- 5 — Hygiene standards are very good
- 3 — Hygiene standards are generally satisfactory
- 0 — Urgent improvement is required
In Wales, it is a legal requirement to display your food hygiene rating. In England, display is currently voluntary, though many businesses choose to display a high rating as a mark of quality.
HACCP: A Legal Requirement
All food businesses in the UK are legally required to implement a food safety management system based on HACCP principles. HACCP involves:
- Identifying potential food safety hazards
- Determining critical control points (CCPs) where hazards can be controlled
- Setting critical limits and monitoring procedures
- Taking corrective action when limits are breached
- Keeping accurate records
For smaller businesses, the FSA provides a simplified tool called Safer Food, Better Business (SFBB) to help implement HACCP principles.
Food Handler Training Requirements
Under UK law, all food handlers must be supervised, instructed, and/or trained in food hygiene matters commensurate with their work activity. While there is no legal requirement for a specific qualification, food hygiene training is strongly recommended and widely expected by environmental health officers during inspections.
Training should cover:
- Personal hygiene
- The four C's: Cleaning, Cooking, Chilling, and Cross-contamination
- Food storage and temperature control
- Allergen awareness
Allergen Regulations
Under Natasha's Law (which came into force in October 2021), all food businesses in England, Wales, and Northern Ireland must provide full ingredient and allergen labelling on all pre-packed for direct sale (PPDS) foods. The 14 major allergens must be clearly identified on packaging or menus.
