Introduction
The Labour government's sweeping employment law reforms are set to bring the most significant changes to UK workplace legislation in decades. From day-one rights to strengthened trade union powers, businesses of all sizes need to understand what's coming and how to prepare.
Key Changes to Expect
1. Day-One Employment Rights
Under the new Employment Rights Bill, employees will gain unfair dismissal protection from their very first day of work — removing the current two-year qualifying period. This means businesses must ensure robust recruitment processes and clear performance management frameworks are in place from the outset.
2. Flexible Working as a Default
Flexible working will become a default right for all employees from day one, rather than something they must request after 26 weeks. Employers will need to demonstrate genuine business reasons for refusing flexible arrangements.
3. Strengthened Sick Pay
Statutory Sick Pay (SSP) will be available from day one of illness, removing the current three waiting days. The lower earnings limit for SSP eligibility will also be removed, extending coverage to lower-paid workers.
4. Zero-Hours Contract Reforms
Workers on zero-hours contracts will gain the right to request a guaranteed-hours contract after a qualifying period. Employers will also be required to give reasonable notice of shifts and compensate workers for last-minute cancellations.
5. Trade Union Rights
The reforms include repealing the 2016 Trade Union Act, making it easier for unions to organise, strike, and access workplaces. Businesses should review their employee relations strategies accordingly.
What Should Businesses Do Now?
Preparation is key. Here's what we recommend:
- Review your employment contracts to ensure they reflect the new rights.
- Update your HR policies on flexible working, sick leave, and disciplinary procedures.
- Train your managers on the new legal landscape to avoid costly tribunal claims.
- Invest in compliance training to keep your team informed and your business protected.
