Section 5 – Possession of Controlled Drugs

  1. Unless allowed by special rules, it’s illegal to have a controlled drug.
  2. If you have a controlled drug without permission, you’re committing an offence.
  3. It’s also a crime to have a controlled drug with the plan to give or sell it to someone else, unless the law allows it.
  4. There are two possible defences if caught with a controlled drug:

(a) You took it to stop someone else from using it
illegally, and you quickly tried to destroy it or hand it over to the police or another authorised person.

(b) You planned to give it to someone who’s legally
allowed to take it, and you did your best to do so as soon as possible.
